THE MILITARY LEGAL COMMITTEE OF THE AMERICAS

 

The Military Legal Committee of the Americas (COJUMA) was established in 1995 and now comprises 20 nations of the Americas, including representation from Argentina, Aruba, Bolivia, Canada, Chile, Colombia, Dominican Republic, Ecuador, El Salvador, Guatemala, Guyana, Honduras, Mexico, Nicaragua, Panama, Paraguay, Peru, Trinidad and Tobago, Uruguay, Venezuela and the United States.  Its purpose is to provide an academic environment in which military legal community members can discuss, better understand and establish a range of appropriate responses to the legal issues faced by military commanders.  COJUMA meets in an academic legal environment and the opinions expressed by its participants do not represent the official position of their countries on the matters that are addressed.

Since its inception COJUMA has published three major military-legal academic studies: the Model Code of Military Justice (1998), the Study of the Agreements of Visiting Armed Forces (2001), and the Legal Manual for Deployment in Military Operations (2004).  COJUMA is a story of cooperation, understanding, camaraderie, and hard work experienced by a group of military representatives from North, Central and South America and the Caribbean.  It is the intent of COJUMA to continue to be a forum for future cooperation and understanding between the representatives of our various military legal departments.

COJUMA Model Code of Military Justice is written in three languages: Spanish, English, and Portuguese. It has now been reviewed and accepted by more than 15 countries. The Model Code contains a preamble and 129 Articles. It incorporates modern legal principles such as due process, an independent judiciary and the right to counsel, while guaranteeing the rights of military members.

The Study of Visiting Forces Agreements (SOFA Study) thoroughly covered five basic topics: Fundamental Concepts and Elements, Administrative and Personnel Issues, Economic Aspects, Operational and Logistics Issues, and Jurisdictional Issues. The study was ratified by 18 countries, including Colombia.

Legal Manual for Deployment in Military Operations is a comprehensive tool to provide legal advice to deployed JAGs and commanders. It is formatted as a desk-book in which the legal advisor can find a thorough analysis of issues that normally arise during deployments.
